We appreciate being. furnished with a copy.of House Resolution 57, recently enacted by the Kentucky House of Representatives. The resolution requested

. technical and _ financial assistance from the Federal Government for the decom-missioning of the low-level radioactive waste disposal site at Maxey Flats.

As you may know, the Nuclear Regulatory Commission, through its Office of 5

Nuclear Regulatory Research, is funding a project at

  • axey Flats being con -

i ducted by Kentucky's Department of Human Resources.

In fiscal year 1980, i

$50,000 was budgeted for this project; the budget for fiscal year 1981 is l

$100,000.

In addition, the NRC is sponsoring six projects that will contrib-ute to a coordinated program to evaluate existing conditions and processes at i3 ;

Maxey Flats. Regarding the decommissioning of Maxey Flats, the NRC is not authorized to provide operating funds for this purpose.

In view of the j

current allocation of responsibilities between the NRC and the Department of i.

Energy (D0E), any program to provide such funds probably would be administered E

by DOE. Accordingly, the Commission believes that it would not be consistent s

with NRC regulatory responsibility to provide funds for decommissioning Maxey i

Flats.

Regarding technical assistance, the NRC is currently authorized to provide

,i such assistance pursuant to Section 274 of the Atomic Energy Act of 1954, as ll amended. Since 1974, the NRC has provided substantial assistance to the Commonwealth of Kentucky regarding the Maxey Flats site. Accordingly, the i

Comission believes there is sufficient legislative authority for NRC to Q

provide technical assistance. Thus, additional legislation is not needed.
