Dear Wolff:

Thank you for the opportunity to review New Mexico Radiation Protection-Regulation 3-800, requiring a specific license for transportation of nuclear waste on the highways.

Sections 73.37 and 73.72 of 10 CFR 73 require each licensee who transports or delivers to a carrier certain amounts of spent fuel to make certain specific arrangements with and reports to the NRC. Any license issued by New Mexico should not conflict with those requirements. We believe the State should consult

..with NRC in the decision to preserve confidentiality (see paragraph F of regulation 3-800).

The terms' " Division" and " Director" should be identified.

We are preparing a letter to all States and all State Liaison Officers in which we explain-NRC's spent fuel route surveys and the requirements of 10 CFR 73 as related to spent fuel.

Please let us know of any changes you may make in regulation 3-800 as a result of our comments.
