CHAIRMAN AHEARNE:- " tis morning, we are continuing 3
our addressal of a Policy Statement regarding the Action Plan.
4 This was an item which had been addressed several times S
last week.
It had been postponed until this morning at the 6
request of Commissioner Bradford and the concurrence of the 7
-Commission in order for Commissioner Braiford to have available 8
his dissenting views.
9 At the last meeting, Commissioner Bradford mentioned O
that he had no -- it was all right with him if we then went l'
ahead in addressing it in his absence, and we do now have his 2
1 concurring views.

There have also been, I guess, a few modifications that 14 I had distributed, clarifying statements, and I believe everybody 15 has those.
16 Len, do we now have -- do you have any problems with 17 any of those clarifying statements?
18 MR. BICKWIT:
I had none.
19 CHAIRMAN AHEARNE:
There are -- Commissioner Gilinsky 20 has a dissent -- separate views that were distributed this 21 morning, as well as I mentioned, Commissioner Bradford's.
22 I would propose, if there is a majority in agreement 23 with the Policy Statement, that we-consider moving ahead with 24 the P'olicy Statement and that we consider thinking about 25 commenting upon the dissenting views at a later date.

2 COMMISSIONER-KENNEDY:
Commenting on them?
3 CHAIRMAN AHEARNE:
Or replying to them.
I'm not.
4 sure whether it would be necessary to reply to them.
5 COMMISSIONER KENNEDY: Well, normally if one is going 6
to reply to them, it is done in the context of the issuance; 7
isn't it?
I mean, does one ---
MR. BICKWIT:
Normally that's the case, but the 8
Commission, of course, is free to go forward with this g
Policy Statement and then comment at a later stage, or not to 10 comment.
COMMISSIONER KENNEDY:
That would be my proposal.

Yes.
14 CHAIRMAN AHEARNE: Vick, do you have any ---
COMMISSIONER GILIUSKY:
No, I don't have anything 16 further.
17 CHAIRMAN AHEARNE:
Dick, did you have any other ---
18 COMMISSIONER KENNEDY:
No.
I would request Counsel, 19 however, to. prepare a draft of response to the letter of 20 June 13, 1980 from William S.
Jordan, III, Counsel of the 21 New England Coalition on Nuclear Pollution, which addresses 22 the Policy Statement.
23 MR..BICKWIT:
Fine.
24 CHAIRMAN AHEARNE:
I would agree with that.

COMMISSIONER GILINSKY:
Have we all gotten that?
2 COMMISSIONER KENNEDY:
Yes, it is addressed to everybody.
It came in an envelope to everybody hand delivered.
4 CHAIRMAN AHEARNE: I got it this morning, or at least 5
it was in my mail box this morning.
6 Well, if there are no other comments, can I propose 7
we adopt the -- Well, I can propose.
I propose we adopt the 8
Policy Statement as modified.
9-(Chorus of ayes.)
10 COMMISSIONER GILINSKY:
I opposed it, principally 11 on the grounds that I didn't approve the way the Commission 12 dealt with those new requirements which exceeded the 13 requirements which are opposed by regulations that would be 14 handled in hearings.
15 CHAIRMAN AHEARNE:
All right.
