Dear Mr. Helfrich:
Enclosed please find an application from Teledyne Precision-Cincinnati for a license to export to Argentina one butt welder to be used for welding end caps to zircaloy-4 clad fuel rods which will be installed in the Tecca fuel fabric-ation facility. As NRC mentioned at the May 30, 1980 SNEC meeting, some Commissioners have questioned whether this type of equipment should be under the licensing jurisdiction of the NRC.
In the interim, however, we believe that the application should be processed as an NRC export license application while this question is being resolved, since the equipment is not covered by current Commerce Department validated licensing requirements.
Accordingly, we would appreciate your views, in accordance with 9'.ablished procedures and from the overall perspective of the Executive Branch, as to whether the issuance of the requested license would be inimical to the interests of the United States, including the common defense and security, and whether the proposed export meets the applicable criteria in the Atomic Energy Act as amended by the Nuclear Nonproliferation Act of 1978. We will keep you advised of the status of the Commission's deliberations on whether to assume additional export licensing authority over fuel fabrication equipment.
