MEMORANDUM AND ORDER SUSPENDING MATTERS RELATING TO EMERGENCY PLANS (June 19,1980)

In our May 22, 1980 Memorandum and Order (at p. 14), we provided that parties may amend their emergency planning con-tentions within twenty days (plus five days for mailing) follow-ing the service of licensee's revised emergency plan. *That revised plan (" Revision 2") has now been served, by hand to some t

parties on June 9, and by mail to others on June 10.

The r'evi-sion is much more substantial than was contemplated by the board at the time of our May 22 order.

Indeed, as stated in licdnsee's covering memorandum, due to the extent of the changes, it was not feasible to indicate the changes (from the version previously provided) through the use of revision bars.

This, of course, exacerbates the problem of sorting out what is new in the revised emergency plan.

- The situation is further complicated by the fact that two other-substantial documents which must be digested by the parties have been issued in the same time frame by the NRC staff -- the

" Class 9" sequence report on June 2, and the SER on June 16.

Accordingly, it would be an. unnecessary and unreasonable burden to require parties to formulate contentions and take other actions, such as requesting discovery based upon new information, on the emergency plan, at the same time that other extensive documents must be dealt with, all within the prehearing schedule for other events also established in the May 22, 1980 order.

That schedule, triggered by service of the SER on June 16, 1980, 1/

requires much concentrated effort by all parties.

ccordingly, the board, sua sconte, until further order, suspends the requirement for taking any steps, including the filing of amended, specified or new contentions or discovery requests based upon new information, predicated upon the issue' of emergency planning.

The " days before hearing" event schedule adopted in the May 22, 1980 order will be implemented with the establish-ment of specific dates by a separate board order.
