ORDER The Comission has elected not to review ALAB-590 on its own initiative.

The Commission's detemination not to review the Atomic Safety and Licensing Appeal Board decision does not constitute a departure from the standard for determining whether a prospective intervenor has set forth an acceptable con-tention as articulated in Mississippi Power and Licht Co. (Grand Gulf Nuclear Station, Units 1 and 2), ALAB-130, 6 AEC 423 (1973).

Chairman Ahearne dissents a.7d would suninrily reverse ALAB-590.

Comissioners Gilinsky and Bradford were not present, but had previously voted by notat1or,'

to approve issuance of the Order. Accordingly, the formal. vote of the Comission was 3-0 to issue this Order.
