Dear Mr. Pofahl:
Thank you for your recent letter expressing concern about the delay in placing TMI-l back into service. On July 2,- 1979, the Commission ordered that TMI-1 remain in a cold shutdown condition until further order by the Comission itself and stated that a public hearing would be held prior to restart of THI-1. The Commission believes that public participation is a vital ingredient dealing with those matters related to the TMI-l restart. On August 9,1979, the Comission issued an additional Order on TMI 1 specifying the basis for. the Shutdown Order and the procedures to goverr the hearing regarding any TMI-l restart. On the basis of this hearing, the Commission will determine whether any further operation of TMI-l will be permitted and, if so, under what conditions. I have enclosed a copy of the August 9,1979 Order for your information. The Commission's Order also identifies a number of items that must be resolved prior to restart. These items, which are listed on pages 5-7 of the Order, include but go beyond that required for restart of other Babcock & Wilcox design pressurized water reactors similar to TMI Units 1 and 2. Included in these additional items are items recommended by the Lessons Learned Task Force, which studied the TMI accident. The Commission carefully considered the time required for completing all tasks related to the Order on TMI-l and which must be completed prior to any restart of TMI-1. A Commission schedule calling for expeditious handling of the necessary fiRC staff actions and procedural actions required for the hearing process is provided on the last page of the Commission's Order. The Cc.missien has deter.cined that certain additicnal icng-tar:n acticns are, fer the reasons given below, recuired to be c:cpiated as prc= ly as practicable, and that reascnable prcgress en the c:cpletien of such acticns pricr to res art is recuired, in order to prcvide reasonable assurance that the facility can be c;erated safely over the long ter=. Tnis Order and notica cf hearing further establishes precedures for a hearing and decision en-the particular issues identified in Section V of this Order. In additien, tne NRC staff begart an icrediate reevaluatica cf :ne design features of 31;i reactors to ce arnine whe-her additional safety corrections or icprevecents were necessary with respect c tese reae:crs. This evaluatien invcived numercus cee ings wid 33W and cr.etain of the affec:ed licensees. The evaluation identified design features as discussed above which indicated that BaW designed reacters are unusually sensitive to certain off-normal trans rent ccnditiens originating in :ne seccndary system. As a result, an additional bulletin was issued by IE which instructed hoiders of ecerating licenses for 31W designed reac crs to take further acticro, including i=ediate changes to decrease the reac:cr hi;P pressure tric ceint and -increase the pressuri:er pilot-c::eraced reif ef valve setting. Also, as a result cf this' evaluation, the NRC skaff identified certain c her safety cencerns that warranted aeditional shcrt-term design and crecedural changes at ccerating facilities having 31W designed reac crs. Tnese were identified as itams (a).through (e) en page 1-7 i cf the Office of "uclear Reac:cr.egulation Status Re;:or: to the Cemission of Acril 25,1979.
