CHAIRMAN AHEARNE: The Commission meets this afternoon 3
for an Affirmation Session.
4 Mr. Secretary?
5 MR. CHILK: The first paper is SECY-A-80-4A, which is 6
a Commission review of ALAB-502 in the matter of Rochester Gas & Electric Corporation in which the Commission, by a 3-2 8
vote with Commissioners Gilinsky, Kennedy and Hendrie 9'
cc..atituting a majority and the Chairman and Commission B'radford 10 dissenting, have affirmed the decision of the Appeal Board in 11 ALAB-502.
12 The Order consists of a one-page Order with separate 13 views of Commissioners Hendrie and Kennedy, the separate 14 views of Commissioner Gilinsky, the dissenting view of the 15 Chairman of which Commissioner Bradford concurrs.
In the 16 absence of Commissioner Hendrie, Chairman Ahearne has agreed 17 not to participate in this voting in order that the will of 18 the majority can be executed.

The second item deals with the Petition 21 by UCS concerning fire protection and environmental qualificationd 22 n
e mm ssion, by a unanimous vote, has approved the 23 Memorandum and Order which has been distributed to you.
As I indicated, it is a petition for emergency and remedial relief l

filed by the Union of Concerned Scientists and the petition 2
sought action by the Commission in areas of fire protection 3
for electrical cables and environmental qualifications of 4
electrical components.
There is attached to the Memorandum 5
and order, the reparate comments of Commissioners Kennedy 6
and Hendrie.
The Order was distributed to you earlier.
7 There have been changes, late changes, a footnote 8 to be 8
added on page 10, and the minor modification of footnote 7, 9
and I believe you all have had those.

MR. CHILK:
The last one is SECY-80-202, the 12 13 Role of the Staff in Waste Confidence Proceeding.
The 14 Commission, by a 5 to 0 vote has approved the Memorandum and 15 Order which informs the participants of the establishment of 16 a w rking group and responds to motions filed by the staff 17 regarding the staff's role in the proceeding,which has been filed by the NRDC and the California Energy Commission.
