Dear Mr. ficCorkle:
Pursant to the provisions of 10 CFR 73.6,11onsanto Research Corporation (NRC license SNM567) hereby requests an exemption from the requirements of 10 CFR 73.47. We wish to possess and present for shipment plutonium with an isotopic concentration greater than 78% of plutonium 238 without being subject to the physical security provisions of said section.
We are normally exempt from 10 CFR 73.47 in that we receive, possess and present for shipment plutonium with an isotopic concentration in excess of 80% plutonium 238.
Howwver, the plutonium we now routinely purchase from the U.S. Department of Energy is only 79% enriched in Pu-238 because the plutonium-238 has decayed (half-life of 87.5 years). Thus, since we purchase more than 15 grams of this plutonium we should be sub-ject to physical security measures described in Part 73 unless we receive the requested exemption.
We are holding up further shipments of the plutonium-238 from the DOE subject to our receipt of this exemption.
Consequently, we ask for your prompt action to grant our request.
