Dear Mr. Doherty:
This is in reply to your letter dated May 28, 1980, in which you requested, pursuant to the Freedom of Information Act, copies of 18 documents which you variously described.
We note that, for each document you requested, you have complied with our requirement of an explanation as to why each document sought is necessary to the preparation of your case on a particular issue which you, as an intervenor, have proffered for consideration by the Licensing Board in the Allens Creek proceeding.
4 In response to your request, the documents listed in Appendix A are enclosed. Please note that we are unable to provide you with copies of your items 6 and 14, because item 6 was insufficiently described for us to locate it in our files, and item 14, which we located frcm the Accession Number you provided, turned out to be unrelated to the subject matter you described and also to the contention you cited.
In conformity with our previous agreement concerning a partial waiver of fees, we have granted you a waiver of 75% of the fees involved in reproducing the 57 pages of documents enclosed, excluding your item 15.
With respect to item 15, we note that this document relates to a contention filed by the Texas Public Interest Research Group rather than by you, hence, it does not qualify for a 75% waiver of fees.
For all of the documents enclosed, please send a check in the amount of
$1.73 payable to the "U.S. Nuclear Regulatory Commission" along with a copy of this letter, to the Director, Division of Rules and Records, MNBB-4210, U.S. Nuclear Regulatory Commission, Washington, DC 20555.
