This is in regard to your request for approval of a route to be used for transport of spent reactor fuel as contained in your letter of December 26, 1979.

We have detemined that the " Primary Routing" as submitted with your

December 26, 1979 letter passes through heavily populated areas and thus does not meet the requirements of 10 CFR Part 73.37(a)(3). Accordingly, in i
view of the existence of an acceptable alternative route, the use of this route is disapproved.
The " Alternate Routing" also submitted with your December 26, 1979 letter is judged to meet the regulatory requirements in accordance with 10 CFR Part 73.37 and accordingly is approved.
m Please. note that assuring highway safety is the responsibility of the licensee and carrier and our approval is not intended to provide relief in this regard. Furthemore, the approval does not guarantee that there will be no local or state legislation applicable to the route that restricts or prohibits the movement of radioactive material.
During the spring months when inclement weather with accompanying hazardous road conditions can occur with short notice, the appropriate state police should be contacted with regard to road conditions before a shipment cocuences.
The initial arrangements with law enforcement agencies along the route, as required by 10 CFR Part 73.37(a)(2), have been completed by the NRC staff.
Data relating to these arrangements and a ecpy of the approved route are enclosed. This infomation is to be incorporated into your shipment plan and provided to your carrier along with instructions regarding its use.

each individual shipment still apply.
Since the attachment to your letter of December 26, 1979 contains infor-mation of a type specified in 10 CFR Part 2.790(d), it is deemed to be commercial or financial infonnation within the meaning of 10 CFR Part 9.S(a)(4) and shall be subject to disclosure only in accordance with the provisions of 10 CFP,Part 9.12.
For the same reason, the enclosure to this letter is being withheld.
