Dear Chairman:

This Co= mission believes that the continued certification of the Metropolitan-Edison Company (Met-Ed) as a public utility, and its financial viability, are central to the concerns of this Commission in our ongoing proceeding concerning this Company and the General Public Utilities Corporations (GPU) system.

The events surrounding the incident at Three Mile Island Unit #2 on March 28, 1979, led to this Commission issuing (a) a rule to show cause as to why the cost of TMI #1 should not be removed from the rates of the Met-Ed and the Pennsylvania Electric Company (Penelec) since TMI #1 is not operating; and (b) a rule to show cause as to the continued ability of Met-Ed to provide safe, adequ. ate and reliable electric service at just and reason-able rates.

A further issue is the extent to which the utility should be allowed to recover through its current rates, the cost of replacement power while the TMI units #1 and #2 are out of service.

A NRC employee, John C. Collins, was quoted in the Tuesday, March 18, 1980, Pittsburgh Post-Gazette as saying concerning Three Mile Island that the NRC officials "have no intention of leaving that plant," and " contingency plans are being developed."

As a result of the above statement, this Com-mission requests that the Nuclear Regulatory Commission address the following scenarios:

(1)

In the event that a licensee and/or owner of a nuclear generating power plant is financially unable to adequately maintain, operate and/or repair a disabled unit,

  • what is the responsibility of the NRC for the maintenance, operation and/or repair of such facility?

(Please enumerate the specific Federal laws and/or regulations empowered the NRC in such case.)

In the event.that the licensee and/or owner of a nuclear generating power plant are now or in the near future financially unable to adequately maintain, operate and/or repair the units, does the NRC have any existing contingency plans, or is the NRC currently developing any contingency plans to cover this possibility?
