Gentlemen:
Immediately subsequent to the hearings on the aircraft crash probability issue, I initiated efforts to obtain further information concerning US Air flight No. 170 regarding which Intervenors' witr.'ss, Dr. Johnsrud, testified.
Although the desired information has been slower than anticipated in coming, I recently received the attached letter (undated) from the First Officer of that flight. His letter is in reply to my letter to him dated April 29, 1980, a copy of which is also attached.
I have not as yet received any reply from the Pilot of the aircraft, although I am continuing to pursue the matter with him. Please note that I am informed that this flight was commanded by a two-person flight crew, a pilot and first officer.
Until a reply is received from the Pilot, the Staff does not believe it appropriate to either characterize the. effect that the substance of the First Officer's letter may have on Dr. Johnsrud's testimony, or to offer this letter in evidence. Rather, it is being provided at this time solely for the purpose of notifying the Appeal Board and parties of my efforts and providing the results thereof, however limited, for everyone's information. Upon receipt, the pilot's response to mv letter will similarly be provided to the Appeal Board and parties. At th.t time, I will also provide the Staff's suggestion for treatment of both letters vis-a-vis the record in this proceeding, e.g.,
a motion to open the record for receipt of Staff exhibits, if appropriate.

cs Jear Sir, Per our telecon and your request, I restate that the statement that was attributed to one of the pilots on Flight #1'70,1/24/80 was not made by me nor did I hear such a statement being made by anyone else crew or otherwise.
As to the statement by the witness that we flew "directly over" the reactor, I cannot recall individual flights but I doubt that ';his was the case. In most instances our normal flight path takes us around the Island in a counter-clockwise direction. In rare instances, speed and altitude permitting, we will turn inside the island, but rarely, if ever do we fly over the top of the plant as we are conscious of the towers and prefer to keep large obstacles such as the towers in sight for reasons of safety.

This is to confirm our phone conversation last week, regarding U.S. Air Flight No. 170 on January 24, 1980 from Pittsburgh to Harrisburg, Pennsyl-vania, of which, I understand, you.were in command.
As I explained, an NRC hearing was held in Harrisburg on February 25, 1980 concerning the Three Mile Island Nuclear Station, Unit 2, in particular, regarding aircraft crash probabilities. At this hearing, the Intervenors presented a witness, Dr. Judith Johnsrud, who testified about her experience on the above flight, stating that on the approach into Harrisburg Inter-national Airport, the plane flew directly over the Three Mile Island Unit 2 facility. Her visual impression of this over flight was confirmed, she asserted, by the pilot, with whom she spoke after the plane arrived in Harrisburg. A copy of her testimony on this point is enclosed for your information.
Of concern to the NRC Staff is (1) whether inquiry was made of you as stated on lines 11-12 of page 608 of the enclosed transcript and (2) whether, if fact, you did fly directly over the nuclear power plant during the above landing.
Your prompt reply to the above is requested.
