Dear Mr. DeYoung:
In our letter of June 4, 1976, submitting our Appendix I evaluation for Davis-Bease Unit No. 1, we had indicated that the information requested in Item 2 of your February 19, 1976 letcer, proposed technical specifi-cations to keep the radioactive release from the unit to unrestricted areas as low as practicable, would be submitted to the NRC by September 1, 1976. This commitment was based on a expeditious review by the staff of our Appendix I submittal, using the NRC's new draft technical specifi-cation transmitted to us May 7, 1976, and timely resolution of ambiguities and possible modifications in these draft technical specifications.
To date, we have not recieved comments from the NRC on our Appendix I evaluation submittal, and the staff has been hesitant to discuss specific details concerning the May 7, 1976 draft technical specifications.
In view of the above, it is not not possible to maintain our original schedule and submit technical specifications for radioactive releases by September 1, 1976. We are presently proceeding with what guidance we do have from the staff and will be able to submit technical specifications to the NRC by September 20, 1976.
