The Department of Justice has filed a motion dated Ma3 21, 1980 (corrected on May 23, 1980) to establish a trial date and other procedural dates in this proceeding.
In its order of May 13, 1980 (" Order Extending Procedural Dates to Accommodate Settlement Negotiations, and Notice of Prehearing Conference"),
this Board set a prehearing conference for June 10, 1980, which has as one of its purposes "to adopt a revised or amended schedule to govern the evidentiary hearing and other procedural aspects of this proceeding".
The Board thus evidently contemplates ruling on schedule matters and other procedural aspects of this proceeding after

it has received the June 9, 1980 status reports regarding settlement negotiations, and after it has heard from the parties as to their views o~n schedule 2 natters based on what has occurred up to June 10, 1980, the date of the prehearing conference.

is TUGCO's view that the Board has chosen the proper course, that it should adhere to the sequence of events and decisions already announced, and that it should defer ruling on the Department's motion until at least the June 10,.1980 prehearing conference.
We wish to emphasize that our disagreement is with.the proposed timing of the decision on schedule.
In the present posture of this proceedings, TUGCO, at least, has no basis on which to state now whether, on June 10th, it will agree or disagree with the schedule now proposed by the Department.
Our ability to speak to that matter depends on what transpires between now and June 10th.
In short, the Department's request to establish a trial

'date is premature and the Board should defer ruling on that request and adhere to its previous direction that parties be prepared to address such schedule matters at the June 10, 1980 prehearing conference.
