SETTLEMENT STATUS REPORT OF DEPARTMENT OF JUSTICE On May 13, 1980, the Atomic Safety and Licensing Board
(" Licensing Board") issued an Order extending the period for settlement discussions an additional tnirty days to June 9, 1980.
On the same day, the Atomic Safety and Licensing Appeal Board (" Appeal Board") filed an accompanying Order deferring action on the production of documents for which Applicants have claimed a settlement privilege.
Both Orders encouraged tne parties to use this additional time to further explore settlement and required the parties to file supplemental Settlement Status Reports on June 9, 1980.
Therefore, pursuant to the aforementioned Orders, the Department of Justice (" Department") hereby submits its Settlement Status Report.
Since filing the Department's Settlement Status Report on May 9, 1980, the Department's participation in settlement discussions has been limited.

A telephone conference was also held among the governmental parties on May 15, 1980 and June 2, 1980.
In its May 21, 1980 Motion to Establish a Trial Date and Other Procedural Dates, the Department notified the Licensing i
Board that counsel for Texas Utilities Generating Company
("TUGCO") and Houston Lighting and Light Power Company ("HL&P")
had informed the Department that a potential settlement on the basis of its May 14, 1980 meeting was not presently possible, thus making a trial more likely than the Department's May 9, 1980 Settlement Status Report had indicated.
The Department's recent efforts to reach a basis for set-tlement appear to have reached a point of diminishing returns.
Thus, while the Department believes that an optimum resolution of the complex issues presented in these proceedings might be achieved by an amicable settlement of the private and governmen-tal parties, the Department also believes _that any further extension of time to explore settlement without an established trial date would not appear to serve the public interest.

Accordingly, the Department urges the Licensing Board to establish a trial dr.te at its earliest convenience to accomodate completion of outstanding discovery, including a resolution of the discovery matter pending before the Appeal Board, and to expedite final trial preparation.
