IMPOSITION OF CIVIL PENALTIES - 58,000' By EN-79-11, dated October 10, 1979, and EN-79-11A, dated January 10, 1980, the Commission was notified of proposed civil penalty action against Diagnostic Isotopes, Incorporated, based on alleged items of noncompliance relating to the licensee's radiopharmaceutical operations.
The licensee responded to the proposed action in letters dated November 5,1979, and February 14, 1980.
After consideration of the licensee's responses, the IE staff concluded that, with the exception of an alleged item of noncompliance relating to the licensee's alleged failure to check each batch of eluate for molybdenum content, the items of noncompliance did occur and no adequate reasons were given for mitigation or remission of the proposed penalties.
Accordingly, an Order Imposing Civil Penalties in the amount of Eight Thousand Dollars has been issued today.
The licensee and the State of New Jersey are being informed by telephone.
Since f.his matter has been the subject of an NRC news release, no additional release is planned.
The Office of Public Affairs will respond to inquiries as received.
Under the terms of the Ord'er, the licensee may, within twenty-five days of the date of the Order, pay the civil penalties or request a hearing.
