LICENSEE'S RESPONSE TO MOTION TO COMPEL OF PENNSYLVANIA PUBLIC UTILITY COMMISSION By motion dated April 17, 1980, Pennsylvania Public Utility Commission ("PUC") seeks information on cash flow studies prepared by or for Licensee since January 29, 1979, additional to the information supplied by Licensee in its March 17, 1980 Response to Interrogatory No.

6.

By filing dated February 25, 1980, Licensee objected to Interrogatory No. 6 on the grounds that it was unlimited in scope and time frame; but Licensee did, in its March 17 Response, supply its most recent cash flow projections and short-term debt forecast.

Thereafter, in a letter dated March 26, 1980,.from the PUC counsel to the undersigned, which was served on the Board and parties, the PUC stated that " Interrogatory No. 6 which asks for cash flow studies prepared by or for Met Ed includes all cash flow studies prepared or submitted on or after January 29, 1979 until and including. January 29, 1980."

Licensee is assembling additional cash flow information responsive to the PUC's March 26 specification of its earlier discovery request,-and expects to be able to supply this s 0 0 5 280 //$l

o information by May 2, 1980, or shortly thereafter.

Accordingly, Licensee requests that the Board withhold ruling on the PUC's April 17 Motion unless or until the Board is informed by the PUC that Licensee's additional response is not satisfactory.

Licensee's responses to PUC's discovery requests are voluntary in nature; Licensee does not agree that NRC regula-tions sanction discovery by State agencies participating pursuant to 10 CFR 2.715(c).

Such agencies are not " parties" entitled to discovery under 10 CFR 2.740 (a).
