Modification of Maine Yankee's Limiting Condition for Operation (LCO's) Technical Specifications Pursuant to Section 50.59 of the Commissions Rules and Regulations, Maine Yankee proposes the following changes and additions to Appendix A of the Operating License.

Proposed Change Reference is made to the Technical Specifications contained in Appendix A to Operating License DPR-36 issued to the Maine Yankee Atomic Power Company for the Maine Yankee Plant. We propose to modify these specifications as follows:

1.

Revise the Definition section of the current specifications to modify the present definition of the term OPERABLE.

2.

Modify the existing specification cection which applies to Limiting Conditions for Operations to include clarifying information on (LCO) applicability.

Nuclear Regulatory Commission May 20, 1980 Attention: Office of Nuclear Reactor Regulation Page 2 Reason for Change Reference (b) requested that all Power Reactor Licensees submit proposed changes to current technical specifications for the purpose of clarification as to the meaning of the term OPERABLE as it applies to the single failure criterion for safety systems in power reactors. This submittal, therefore,stddresses that request. Maine Yankee has, however, modified the requirement as provided in the model specifications which stipulates that the plant be placed in the Hot Standby condition within (1) hour, and in the Hot Shutdown condition within the next 6 hours6.944444e-5 days <br />0.00167 hours <br />9.920635e-6 weeks <br />2.283e-6 months <br /> of identification that both conditions (1) and (2) as defined in section 3.0.5 of the model specifications are not being met.

Maine Yankee's position relative to these requirements, based upon extensive plant operating experience, is that (1) hour is an insufficient period of time to allow the plant to be taken from 100 percent power to a Hot Standby condition in the controlled manner.

In order to achieve the (1) hour Hot Standby objective, it would be necessary to trip the plant from some elevated power level thereby imposing an unnecessary transient on plant systems and equipment. Maine Yankee has, therefore, modified the (1) hour requirement to be consistent with current plant operating philosophy.

Additionally, although the plant could be placed in the Hot Shutdown Condition as defined in the Maine Yankee Technical Specifications within the 6 hour6.944444e-5 days <br />0.00167 hours <br />9.920635e-6 weeks <br />2.283e-6 months <br /> suggested time frame, differences in the Maine Yankee Technical Specifications versus Model mode definitions would preclude the intent of the specifications from being met. Recognizing this intent, Maine Yankee has opted to modify the suggested requirements, based on prudent operating practice, to place the plant in the safest mode in a time frame that does not further compromise plant safety.

It should be noted that the exceptions being taken require the plant to be placed in the most conservative mode (Cold Shutdown) for a potential situation where a safeguard system is not available, in a time frame 7 hours8.101852e-5 days <br />0.00194 hours <br />1.157407e-5 weeks <br />2.6635e-6 months <br /> earlier than required by the Model Technical Specifications.

Safety Considerations The purpose of this change is to clarify existing specifications in accordance with a request made by the NRC. The change does not, in any way, endanger the health and safety of the public. This change has been reviewed by the Nuclear Safety Audit Review Committee.

Fee Determination The USNRC, by letter (Reference (b)), requested that Maine Yankee submit a proposed change to the Technical Specifications; adhering to the guidance outlined in said letter, to assure acceptable use of the term OPERABLE as it applies to the single failure criterion for safety systems in power reactors. We conclude that this amendment is exempt rrom any fees defined in 10CFR170.12(c) since this amendment results from a written NRC request for an application to amend the Technical Specifications.
