SUBJECT:
COMPLETION OF WASTE MANAGEMENT URANIUM REC 0VERY LICENSING BRANCH INVOLVEMENT IN REVIEW 0F COTTER CORPORATION APPLICATION FOR STATE OF COLORADO RADIO-ACTIVE MATERIAL LICENSE TO OPERATE SCHWARTZWALDER SORTER Cotter Corporation initiated a uranium ore sort'er operation immediately adjacent to the Schwartzwalder Mine in Jefferson County, hlorado, in March 1976. A determination was made by the Colorado Depa-tment of Health in November 1977 that a radioactive material license was needed to permit continued operation of this facility.. As a result, Cotter submitted an application and environmental report to CDH in August 1978.
USNRC WMUR involvement in this matter was in response to a technical assistance request from the Colorado State Department of Health dated November 17, 1978 and has consisted of the following:
1.
Review of the original license application and environmental report dated August 18, 1978 as well as subsequent comments by USEPA and various state agencies.
2.
Review of correspondence between CDH and the applicant.
3.
Telephone discussions with CDH and Cotter concerning above documents and plans for submitting an amended application.
4.
Review of draft of amended application in early April 1980.
5.
Inspection of ore sorter facility and site in company with CDH and Cotter personnel on April 9,1980.
6.
Meeting with applicant and CDH representatives on April 10, 1980 to provide NRC reconmendations for required contents of the proposed amended license application.
Agreement was reached in the April 10, 1980 meeting on the content and i
format of the' amended license application which Cotter Corporation committed to submit to CDH on or before June 9,1980.
Details of the agreement are contained in a trip report by Rothfleisch dated May 7,1980.

File No. WM-30 2-MAY 121980 All further actions required following receipt of the amended application are considered to be well within the technical capabilities of the Colorado Department of Health.
Consequently, involvement by NRC is considered to be completed with the issuance of this memorandum and notif,ication of CDH.
