Dear Mr. Chilk:

Please reference the note to you dated June 27, 1979, f rom Edward S. Christenbury, 02'D, transmitting three letters relating to a request for a hearing. Mr. Christenbury has characteri::ed two of the letters, dated May 3 and June 7, 1979, from Senator Tim McCormack, Ohio State Senate, as constituting a request for a hearing on Davis-Besse Unit 1 as provided in the Cc mission's May 16, 1979, Order.

The Licensees concur with the NRC Staff's conclusions in its June 27, 1979, response to the hearing request that a . hearing is not required-hy law, by public policy, or by the factual context involved-prior to the termination of the suspension accomplished by the Commission's May 16 Order, and that the conduct of a hearing prior to resumption of operation of the facility on terms consistent with the May 15 Order is unnecessary.and unwarranted. These conclusions of the Staff are fully consistent with the Cc= mission's June 21, 1979, order in the Rancho Seco decket.

The Licensees also agree with the NRC Staff that the hearing request leaves open to question certain matters
