NRC STAFF OBJECTION TO DISCOVERY REQUEST OF STEVEN C. SHOLLY On February 25, 1980 Intervenor Steven C. Sholly served a second set of inter-rogatories and document requests on the NRC Staff.

The NRC Staff makes the following objection to Interrogatory 16-005 which was included among those srequests.

The scope of Contention 16 is limited to effects on safe operation of TMI-1 that

may be caused by TMI-2 personnel engaged in TMI-2 decontamination and restoration work using TMI-l facilities.

Third Special Prehearing Conference Order dated January 25, 1980 at 19-20.

Interrogatory 16-005 asks if TMI-2 personnel by committing a deliberate act of sabotage at the TMI-2 facility can cause additional damage to TMI-2.

If the logic used by the Board in rejecting TMIA Contention 4 is applied, such an Lissue appears 'to be beyond the scope _ of this hearing.

In rejecting TMIA Contention 4 the Board ^said that to the. extent the contention raised issues about the threat to TMI-2 it:was beyond the ' scope of _this hearing..See:
