Being unaware at'the time T

of the' potential ex parte question involved, I talked with (or rather, was talked to by).AndFson,~for. perhaps five minutes.

Because I have been j

To thelbest of my-recollection, the conversation was very similar to the

one'sumarized by' William L. Clements in his January 16, 1980 memorandum to the Public Document Room (copy attached).

I suggested that Mr. Anderson put his ~ concerns in a' letter to the Commission.

I have neither seen such a letter nor talked further with Mr. Anderson.

On aanuary 2 1980,' ~I'ine~t with Peter Anderson who represents Hisconsin's T Environmental (Decade to discuss the petition filed by the Decade pursuant'

-. O to 10 CFR 2.206 regarding the Point Beach facility.

At the time, I was unaware that a proceeding.had been commenced involving the Decade and Wisconsin Electric Power Company (MEPC0) arising from the confirmatory-

, order -issued-by the staff. effective November 30 modifying WEPCO's operating license for Point-Beach Nuclear Plant, Unit 1.

In light of this pending

. proceeding, pursua'nt to 10 CFR 2.780(c), I am hereby notifying the parties to the Point Beach License Amendment proceeding of my conversation with Mr. Anderson. '

Mr. Anderson and I discussed the desirability of a metallurgical analysis of the five tubes identified in the licensee's November 16 LER to determin' whether they were also subject to intergranular attack..

e

-Mr. Anderson suggested a blind test of the results of the eddy current testing for these five tubes in order to determine whether the defects ident{fied in the LER actually dated to pre-1975. Mr. Anderson indicated that the staff of the Wisconsin Public Service Commission had represented to him that information obtained from the licensee suggested that inter-granular attack proceeded slowly to.a level of 40% defective at which-time.it progressed rapidly to an 80% or 9Cf level. We also discussed briefly Mr._ Anderson's understanding of the circumstances surrounding the issuance of the licensee's November 16th LER.

Finally, Mr. Anderson suggested that, in some instances, the licensee's laboratory data frcs.~

eddy current testing do not agree wit' 'he results of metallurgical-

- ~ T tests performed on tubes removed fro.. ma steam generator.

I. suggested' a

.to." P,r. Anderson that he document his additional concerns in a letter

..dir.ected. to the. staff with copies forwarded to the Commission.
