ORDER DENYING NCPA FMION ECR RECWSIDERATION OR FDDIFICATION OF ORDER OF NOVEMBER 1,1979 (January 16, 1980)
~
By Order dated November 1, 1979, the Board directed the Northern California Power Agency and its mesers (NCPA) to permit representatives of Pacific Gas and-Electric Ccmpany (PGSE) to conduct a preliminary inspection of the filing arrangements of NCPA member cities and a cooperative, and to " green dot" file folders located in the central files of relevant departments other than law departments. A motion for reconsideration or nudification of this order dated Novenber 9,1979, was filed by NCPA.N PG&E was granted leave to file its opposition to this motion and the opposition was filed as of December 5, 1979.
We have e=4ned the motion for reconsideration or nodification of our Order of Noverber 1,1979,' and decline to grant it. Although there may be some
' ambiguities in the stipulatien concerning ' production of documents dated
. April 26, 1978, that stipuleinn 'did establish a " green dotting" procedure for the! central files of PG&E which was followed in connect m with many thousand.
documents. That stipulation also provided that "ccmpara,le procedures which S opies of this motion were apparently subjr to vagaries of the U. S. mails, C
l as same cooies were not received until cuch later and at least one copy was f
not receiv'ed at'all. Of course, this does not affect the merits of the motion.A b tilA 7,[

- are substatively similar will be agreed to for the producticn of decun:ents frcm the files of ths NGA, its I:arber cities... (Stipulation,.p. 6).
The statement in the stipulation that comparabla procedures "will be" agreed to cone erning NCPA documents is not the sane as the language NCPA new urges in its stion for reconsideratien -- nacely, "could be" agreed to Obticn for recensi-deration, p. 3, footnote 1). We do not construe this larguage to give NGA a unilateral option as to the use of green dotting of its metrbers' files.
- NCPA has apparently examined the files of approximately half of its members and. tenders 1the doctments.thus obtained as a ccxnplete response to the requested docunent production. However, we cannot hold that this is necessarily comparable with or substantively similar to the green dotting procedure followed as to PG&E central files. There is even controversy whether PG&E has been
- granted a pre 14m4=ry inspection of NCPA's filirg arrangments, even though it is undisputed that under the stipulation,-PG&E reserved "tne right to a preliminary inspection of [NCPA's] filing arrangements..." (Stipulation, p. 6).
Fairness requiresfthat the_ parties follow essentially the same rules in 1 discovery. :Accordingly, as to the central files of NCPA's msnbers, PG&E shall iforthwith be given a reasonable opportunity to make a pre 14m4=ry inspection of their filing ~arrangementsi If theiparties cannot agree that.the available Jdocument production by NCPA is ccxroarable with or substantially similar to the prior green dotting procedure.(and we encourage _ reasonable efforts;to avoid
~
unnecessary duplication), then PG&E shall' have the right to ccurmence the green-
-dotting process within 14' days thereafter.
