Such notice will invite persons to submit within sixty (60) days after publication of the notice comments or information concerning the antitrust aspects of the application to assist the Director in determining whether significant changes in the licensee!s activities or proposed activities have occurred since the completion of the previous antitrust review in connection with the construction permit pursuant to section 105c of the Act. Such notice will also state -

the notice. In addition, the Director of Nuclear Reactor Regula-tion is to transmit a copy of each application for an operating license to the Attorney General. Under Section 105c, the Attor-ney General will, within 180 days after receipt, render such advice to the Commission as he de'termines to be appropriate in regard to the finding to,be made by the Commission as to whether the activities under the license would create or maintain a situ-ation inconsistant with the antitrust laws. .

However, such review is not required for applications for operating licenses under Section 103 of the Act for which the construction permit was also issued under Section 103, unless the Commission determines, after consultation with the Attorney General, that such review is advisable. A determination that such review is advisable can be -made only on the ground that significant changes in the applicant's activities or proposed activities have occurred subsequent to the previous review by the Attorney General and by the Cc= mission in connection with the construction permit application. Whether or not there have been significant changes is determined without participation by the public.

Under the proposed rule, upon receipt of the antitrust portion of an application for a facility operating license under Section 103 of the Act, the Director of Nuclear Reactor Regula-tion would publish in the Federal Register a notice of receipt- - --

of operating license application and request for antitrust information. Such notice would invite persons to submit, within 60 days after publication of the notice, co==ents or information concerning the antitrust aspects of the application to assist the Director in deternining whether significant changes in the appli-cant's activities or Jroposed activities have occurred since the completion of the previous antitrust review. If the Director subsequently concludes that there hav3 been no significant changes since the completion of the previous antitrust review, a finding of no significant changes is to be published in the Fcderal Register, together with a notice ~ stating that a request for reevaluation of such proposed finding should be submitted within 60 days of publication of the notice. If, as a result of the reevaluation, it is determined tha.t there have been no significant changes , the request will be de- 4 av md a notice of finding of no significant changes will be published in the Federal Register.

Such notice and finding shall become the final NRC cec:sien 30 days after being made. If the Director concludes that signifi-cant chances have occurred since completion of the previous anti-trust review, then the provisiens of Section 2.102 (d) would apply.

regulations, it is apparent that additional time would be re-quired under the proposed rule in order for the Director to issue a finding of no significant changes due to the expanded pe lic participstion. Furthermore, the potential for review by the Attorney General and for a hearing would be increased due to comments or i.nfor=ation received by the Director in the form of allegations respecting the occurrence of significant changes .

When Congress amended Section 105 of the Act in 1970, it made clear that the Commission's scope of review at the operating license stage should be much more limited than at the construction permit stage. Section 105c requires the Com-ndssion to make a threshold detemmination before the Attorney General's advice concerning a possible second antitrust pro-ceeding can be sought. This determinatien is a finding that the applicant's activities have significantly changed subsequent to the construction permit antitrust review. If no "significant changes" in a construction permittee's proposed activities have occurred, then the statute is explicit that there is to L- no antitrust review at the operating license stage. The reason for this limited scope of review at the operating license stage is that Congress was concerned witP possible unf airness to u 'ilities and their investors should they be required to run the antitrust review gauntlet at both the construction permit and operating license stages. Increasing the attention given to antitrust matters by providing for wider public participation is inconsistent with Cengressional intent that the antitrust review at tne operating license stage be a limited one. Furthermore, there is no need for such wider public participation where there has been no ,

determination that the existing. procedure is in any way inade-quate relative to carrying out the requirements of Section 105 of the Act. In sum, although in may be entirely appropriate for the Cc= mission to delegate its authority respecting whether or not significant changes have occurred, the Commission should not expand the antitrust review process by proviibg for public parti-cipation in the determination of whether or not significant changes have occurred.

Section 105c(6) provides that even. i,f the Commission finds that activities under the license would creats or maintain a situation inconsistent with the ' antitrust laws, a license may issue with such conditions as the Commission deems appropriate. The amendments implement the Commission's delegation of its authority under Section 105c(2) of the Atomic Energy Act of 1954, as amended, 42 U.S.C. 5 2135c(2), to make a "significant changes" antitrust determination to the Director of Nuclear Reactor Regulation or the Director of Nuclear Material Safety and Safeguards, as appropriate.
