Appendix J, Section 111, D.l. (a) requires that "..

a set of three Type

/. tests shall be performed, at approximately equal intervals during each 10-year service period.

The third test of each set shall be conducted when the plant is shutdown for t.he 10-year plant inservice inspections."

This requircnent is footnoted to reference 10 CFR 50.55a ghich in turn (50.55a(g)) ref erences ASD: Section XI.

Scction XI states in Paragraph 15-241 that "... inspection intervals [10 years]

represent calendar years after the reactor facility has been placed into conrnercial service."

Indian Point 2 perforced the preopsratienal Type A test on March 9-12, 1971, and has cheduled i.ts first rcrueling shutdown for an 8 week period beginni:

March 28, 1976; however, the licensee does not plan to conduct a Type A test until the second refueling outage scheduled to begin September 1977.

This vould rican t hat a period of approximately 6 1/2 years will have elapsed between Type A tests.

Although Indian Point 2 Technical Specification 4.4.II. A.6 only requires a Type A test "... approximately nidway between the major shutdowns for inservice inspections" and one "... at the end of the 10 year interval,"

the licenree plans to conduct Type A tests in accordance with Section 111.D.l. (a) of Appendix J.

The problen is that the licensee defines-the start date for the 10 year IST program as June 30, 1974, (commercial operation date establishea by the licensee) whereas Region I believes the 10 year Type A inspection interval should be keyed to the date of the preoperational test.

In addition to the Type A test issue, the licensee is also keying his Type E and C test schcdule as required by Appendix J on the June 30,1974 date.

This appears contrary to the requirements of Sections III.D.2 and III.D.3 of Appendix J vhich require Type B and C be perforned at no greater than 2 year intervals.
