l NOTICE OF APPEAL The Cincinnati Gas & Electric Company, et al., pursuant to 10 C.F.R. 52.714a, hereby appeals Memorandum and Order LBE-80-14 of the Atomic Safety and Licensing Board in this proceeding, dated April 22, 1980, on the ground that the un-timely petition for leave to intervene filed jointly by Zimmer Area Citizens and Zimmer Area Citizens of Kentucky should have been denied.

As set forth more fully in the brief in support of this appeal, the Licensing Board's Memorandum and Order fails to follow the Commission's own regulations establishing the requirements for late petitions for leave to intervene.

Accordingly, the Appeal Board should reverse and vacate the 8005210092

Licensing Board's Memorandum and Order and direct that the petition be denied.
