Dear Mr. Keppler:

The following is in response to an inspection conducted by Dr.

M.

Destmann and Miss E. Matson on February 20-22, and 26, 1980, of activities at Dresden Nuclear Power Station Units 1, 2, and 3.

Reference (a) indicated that two items appeared to be in non-compliance with NRC requirements.

Attachment A to this letter contains Commonwealth Edison Company's response to the identified items of non-compliance.

i NRC Docket Nos. 50-10 50-237 50-249 ATTACHMENT A COMMONWEALTH EDISCN ATTACHMENT RESPONSE TO NOTICE OF VIOLATION The items of non-compliance identified in Appendix A with the NRC letter dated March 21, 1980, are responded to in the following paragraphs.

1.

According to Technical Spacification 4.8.E.1.,

the licensee is required as part of the Radiological Environmental Monitorlig Program to collect and analyze a fish sample for gamma isotopic analysis semi-annually.

Contrary to the above, the licensee failed to collect and conduct a required analysis of a fish sample during the first half of 1978.

According to Technical Specifications 6.6.C.2.a(2), the licensee is required as part of the Radiological Environmental Monitorinng Program to report in the annual Operating Report the results of the collection and analysis of a fish sample on a quarterly basis.

Contrary to the above, the licensee failed to report in the 1978 annual Report the analytical results of fish samples collected during the second half of 1978.

Corrective Action Taken and Results Achieved The first 1978 semi-annual collection of fish for Dresden Station was planned for early June 1978.

Sampling continued throughout June until a fish sample was finally taken on July 2, 1978.

The gamma isotopic analysis of this sample and that for the second half of 1978 were reported as required in the contractors monthly report.

However, we inadvertantly overlooked reporting the results of these analyses in the 1978 annual report.

To correct this oversight, an errata was included with the 1979 Annual Report to documer,t the results of the required fish gamma isotopic analysis.

The 1979 Annual Report was issued in April, 1980.

.; Corrective Action To Be Taken To Avoid Further Non-Com611ance To increase the effectiveness of the fish sampling program and as discussed with the inspector, our contractor, Eberline Instrument Corporation, has hired an experienced, qualified sub-contractor to fish the Illinois River for the Dresden (and LaSalle County) Environmental Radiological Programs.

The experience of the sub-contractor should facilitate obtaining the required samples on time.

Date When Full Compliance Will Se Achieved The errata in the 1979 Annual Report has been issued.

We believe we are in full compliance at this time.
