RE0RGANIZATION PLAN NO. 1 of 1980
Dear Dr. Ahearne:
It is the understanding of the ACRS that the Commission will be providing comments to the Congress in the near future regarding the proposed re-organization of the Nuclear Regulatory Commission under Reorganization Plan No.1 of 1980.
Tha Committee offers the following comments regarding this plan, as it impacts on the activities of the ACRS, for consideration in the preparation of applicable Commission coments.
Section 1(b)(2) provides that the Chairman of NRC "shall also initiate the appointment of Members of the Advisory Committee on Reactor Safeguards" as well as other specified officials of the NRC staff and the Chairmen of the Licensing and Appeal Boards.
Inasmuch as the ACRS will continue to report directly to the Commission, under Section 4(d) of the Reorganization Plan, we believe that it is inappro-priate that appointment of members of the ACRS be subject to the provision proposed in Section 1(b)(2) of the reorganization plan.
For the above reason, we recommend the deletion of Section 1(b)(2), and cantinuation of the existing method of making Committee appointments under Section 29 of the Atomic Energy Act.
