This letter is in response to the letters from your office dated September 11, and October 9, 1979, requesting Executive Branch views as to whether is-suance of an export license in accord;nce with the application hereinaf ter described would be inimical to the common defense and security of the United States and whether the proposed export meets the ap-plicable criteria of the Atomic Energy Act of 1954, as amended by the Nuclear Non-Proliferation Act of 1978:

NRC No. XSNM01573 -- Application by Trans-nuclear Inc. for authorization to export to the Federal Republic of Germany 3,010 kilograms of U-235 contained in 86,000 kilograms of uranium enriched to a maximum of 4 percent, plus.64 kilogram of U-235 contained in 16 kilograms of uranium as sampling material.

The low enriched uran-ium in the form of ura.nium hexafluoride will be shipped to RBU Reaktor Brennele-ment Union GmbH, Hanau, FRG, for fabrica-tion into fuel assemblies for four re-loads of the Isar (KKI) Nuclear Power Plant in the FRG.

The proposed export would take place pursuant to i

the Additional Agreement for Cooperation Between the l

United States and the European Ato.aic Energy Community

( EURATOM) as confirmed in a letter from the Delegation of the Commission of the European Communities, a copy of which is enclosed.

EURATOM has adhered to the pro-i visions of its Agreement for Cooperation with the l

United States.

A detailed analysis for the FRG was submitted November 27, 1979 for NRC application No.

XUO8427.

There has been no material change in circum-y

stances since that submission.

%3j As this license request covers four reloads of fuel y

for shipment between 1981 and 1986, the applicant has 13 requested that the license be issued valid until December 31, 1986.

It is the view of the Executive Branch that the license remain valid after March 10, 1980 provided iiii that the President has made the necessary determination d

under Section 126 a.(2) of the Atomic Energy Act extend-IS ing the duration of the first proviso of that Section for W

each 12-month period during the term of the license, or y

EURATOM meets the requirements of Section 126 of.the Act.

lll This proviso should be made a condition of the license.

We certify that the material mentioned in this application, namely 3,010.0 kilograms of U235 contained in 86,000'.0 kilo-grams of total uranium plus 0.640 kilograms of U235 contained

,in 16.0 kilo' grams of total uranium as sampling material, and the transfer of this material will be subject to all terms and conditions of the Additional Agreement for Cooperation, dated July 25, 1960, as amended.

Further, we certify that Reaktor Brennelement Union, GmbH (RBU), Hanau, West Germany, as intermediate consignee (for conversion and manufacture of fuel elements only), and Kernkraftwerk Isar, GmbH, Munich, West Germany,'as ultimate-consignes, are authorized by EURATOM to receive and possess this material pursuant to the aforementioned Agreement for Cooperation.

The material will be used in the RBU facilities for the conversion of UF6 to UO2 and for the manufacture of fuel elements for the reactor KKI - West Germany.
