Fish:
We thank you for your public statement at the Indian Point hearing on Decesi:er 18 in which you called for the phasing out of Indian Point. We feel that in this matter you have reflected the desires of the majority of the residents in the district.
Since you were unable to attend the hearing, we would like to describe to you sc=e of what happened that day. The proceeding began quietly, but that didr': last long. It soon became obvious that the NRC was accepting whatever the officials of PAS.W and Con Ed said as fact, no matter how improbable it was, and the people in the audience began to ask questions and take comments, i

Grimes, the Director of the Emergency Preparedness Task Group, when he apparently felt tha: the audience should be silent until they were allow to speak, said that we should be glad that the hearing was being held locally at all,.since it i
could have been held in Washington D.C.. We took that as a threat that unless

we behave ourselves, future public hearings would be made inaccessible to the i
public.
I Sut we couldn't sit back placidly, because the longer we listened to the i
l dialogue between the NRC ar.d the plant operators, the more we realized that there was really no difference between th'em, that they were of one mind that India. Point should remain open and no facts or argu'ments could dissuade then othe: vise. No matter how it was explained by representatives of New York state that the existing -co. unications network could not notify everyone within* ten cile radius in 15 minutes', which is an NRC requirement, no
2 catter how many people in the audience pointed out the logistical im-possibility of quickly coving more that 200,000 people over narrow, winding roads and bridges, the NRC steadfastly refused to acknowledge that an evacuation was not feasible for this area. In fact, at a press conference later, Mr. Grimes stated that the only real ' problem was in the area of co= unication, implying that once everyone is notified, the physical re-location of people would be no proble=. It was like we had been talking into the wind.
We had 'gone to this hearing hoping that the NRC, a public agency, would place the safety and welfare of the public above other considerations. Instead, we found out that its primary concern is to insure that the Indian Point operators keep their licenses and,in order to do this, they are willing to bend and twist the rules so that Con Ed and PASNY can submit an emergency evacuation plan which will be approved even if it unworkable.
Mr. Fish, we do not believe that Indian Point is safe, we do not believe that an adequate evacuation plan is possible and we will not rest until Indian Points II and III are closed. But it is painfully obvious that the desire of the people is not enough, that we need the help of you and your colleagues in Congress.
Initially, we need answers to the following questions:
- 1. isho approves the emergency evacuation plans that are submitted to the NRC?

- 2. By what date are these-plans supposed to be submitted and approved?

- 3. Can we be assured that this date will not be moved to accomodate the plant. operators if this deadline cannot be met?

- 4. What penalties will be imposed if no adequate evacuation plans _can be devised?

- 5. Will the public have an adeouate oppo tunity tc review these plans r
before they are approved?
- 6. Will there be another hearing when the plant operators revise their plans?
- 7. Finally, and most icportant, we believe that ar.y evacuation plan should have the confidence and approval of the people who are expet.ted to use it.
Not only should the people of Westchester see the co pleted plan, but provision sh'ould be cade, either by a special vote or as a part of a regular election, for the plan to be placed before the voters for their rejection or approval. Only in this way can we be sure that government agencies like the NRC are working in the public interest.
