TRIP REPORT Place and Date February 28 and 29, 1980; Spokane and Ford, Was.hington Purpose i 1) Meet with the State of Washington to determine exactly what technical assistance the state wanted to request on the review of Dawn Mining Company's renewal application and proposed below-grade tailings disposal plan. 2) Discuss with the Environmental Protection Agency (EPA) and the state, EPA's comments on Dawn's application. 3) Visit to Dawn millsite. Attendees NRC, EPA, State of Washington, Dawn Mining Company (a complete list of attendees _is attached). Sumary On the afternoon of February 28, at the request of the State of Washington a meeting was held in Spokane between the Nuclear Regulatory Lommission (NRC), State of Washington, EPA, and Dawn Mining Company. The meeting was requested by the State because of negative comments by EPA on environmental documents prepared by Dawn. Unknown to the NRC, the state had sent these documents to various agencies for review since the state had been planning on using these documents as a basis for licensing actions rather than preparing an independent assessment.

Scarano A.CR 14 250 1 i The purpose of the meeting was to have been to 1) meet with the state to explain the type and scope of independent environmental assessment required by UMTRCA and determine exactly what technical assistance the state wanted to request from NRC, and 2) discuss with EPA and the state, EPA's comments on Dawn's applications. However, unknown to NRC, representatives of Dawn Mining Company were at the meeting to present their response to i EPA's comments. This put the NRC representatives in an uncomfortable position since the NRC had not yet agreed with the state on the exact role to be played by NRC and not having visited the site, NRC was not in a position to comment on the adequacy of Dawn's responses to the EPA comments. J. Linehan informed R. Will (State of Washington) of the NRC's concern over the way the state had set up the meeting and an agreement was reached that Dawn would go ahead with their presentation and that the NRC and the state would then meet after this presentation. Following a general discussion of Dawn's response to the EPA's comments, tLe NRC and State then met. This meeting between the NRC and state con 31sted of a discussion by NRC staff of the review required by UMTRCA and a determination of the exact type and scope of technical assistance being requested by the state for the Dawn project. The state requested that NRC provide whatever technical assistance was necessary to meet the requirements of UMTRCA. In addition, it was agreed to by the state and NRC that the ranewal review and review of the proposed below-grade disposal would be conducted separately with priority being given to f review of the below-grade disposal application. The technical assistance required from NRC was further discussed after the site visit on February i and NRC was written (g on the 29th, a draft agreement between the state 29th. At this meetincopy enclosed). The state was due to get back to NRC with any canments or proposed changes by March 13, 1980. The NRC staff is presently contacting the state to obtain any comments. On the 29th, the NRC, state, and EPA representatives visited the Dawn site. The visit consisted of a tour of the mill and then visits to the existing tailings impoundment, the proposed below-grade pit, and the area along Chamokane Creek where seepage from the existing impoundment 1 ) was surfacing. The tour of the mill indicated good housekeeping practices and good management control. The existing above-grade tailings impoundment appeared to be maintained in good condition with wood chips applied over dry areas to prevent dusting. No significant erosion was observed on the slopes of the tailings dams. The proposed site of the below-grade impoundment is located adjacent to the existing above-grade impoundment. After visiting the tailings area, we proceeded to drive over privately "WM 9

Seepage could actually be observed flowing through the side of the creek's embankment. Based on observations made during the site visit, it appeared that the most significant issue to be considered during our review is seepage from the existing pond. Actions that need to be taken are a for.maJization of the draft agreement drawn up by the NRC and staff." FollowngT=turtion of this agreement the NRC will submit a request for additional information to the state based on our site visit and review of Dawn's application and response to EPA's comments. Two things that were evident throughout our visit that I feel need to be mentioned are the attitude of management level state staff during our meeting and site visit and the lack of knowledge by state staff of what is required by UMTRCA at the present time and what will be required of the state in November 1981. On the first point, it appeared that management level state staff considered the review we would be doing to be just a paper formality that must be met prior to taking a licensing action. This coupled with the lack of knowledge of state staff regarding the requirements of UMTRCA indicates that the state may not have been properly informed or that they do not care to be concerned about these requirements. The lack of knowledge of Wayne Kerr's letter of December 31, 1979, to the state on the requirements of UMTRCA and the licensing action that the state was preparing to take, based on the~ analysis submitted by Dawn, prior to receipt of EPA's comments, indicate that the later may be the case.
