APPLICATION FOR EXPORT OF TWO POWER REACTORS TO TAIWAN (XR-135)

Purpose:

To inform the Comission of the receipt of a license application warranting special attention.

Discussion:

Enclosed for the infcrmation of the Comission are i

copies of a license application dated March 7, 1980 from General Electric Ccmpany for'the export of two boiling water reactors to Taiwan, GE also has applied for a license to supply the initial fuel cores for these power reactors. Comissioner review will be necessary on both these applications. The contract for this project has not been awarded yet; however, GE has requested NRC to initiate the review of this application now in order to expedite the processing time, Commissioners are requested to advise the staff of any particular issues or information which they can identify at this stage and which they wish included in the staff's analysis.

i Pursuant to the regulations in Section 110.30, 110.31 and 1

110.32 of 10CFR Part 110, application is hereby filed for a license to export nuclear equipment for a proposed installation presently known as Taiwan Power Nuclear Units 7 and 8.

End Use Justification General Electric is informed by Taiwan Power Co. that Units 7 and 8 are to be operated solely for the production of electricity to meet the anticipated energy needs for a growing industry including textiles, clothing, TV and other electrical and electronic equipment, processed foods, chemicals, glass, metals and machinery.

General Description of Exports Components, systems and parts, as listed in paragraph (a),

Appendix A to Part 110, for two General Electric forced circulation, single cycle, light water cooled and moderated boiling water reactors with a design power level of 2894 megawatts thermal (984 MWe).

The installation is presently known as Taiwan Power Nuclear Units 7 and 8 and is to be located at Yen Liao, Taiwan, about 50 km east of Taipei.

Applications for Licenses to Export Nuclear Reactors and Fuel i

Dear Mr. Shea:

Enclosed please find this company's application for a license to export two nuclear reactors (letter application) and initial fuel cores (Form NRC-7) for Taiwan Power Nuclear Units 7 and 8.

We ask that review of this application be initiated now, in advance of the utility's award of the project.

The practical and policy reasons for this early review are set forth below.

Taiwan Power is currently preparing bid specifications for Units 7 and 8 to be constructed at Yen Liao for operation in 1988 and 1989, respectively.

General Electric considers itself a serious contender for project selection.

We would note, in t'ais connection, that all of Taiwan Power's units now in operation or under construction are of U.S. origin and that, based on discussions with the prospective consignee, we believe it highly likely that units and fuel of U.S. design will be selected for Units 7 and 8.

We would also note, as respects boiling water reactors, that Taiwan Power already operates the two Chin-Shan l

BWR units and is constructing two more BWR's at Kuo Sheng.

Until now, it has been usual practice to await a firm order before seeking an export license.

We believe, however, that early application submission and export review are warranted here in order to accelerate the timely completion of the expert licensing l

process and thus enhance the prospects for a U.S. supplier to fill the Taiwan order.

For these same reasons, early review is of course employed by the Export-Import Bank.

GENER AL $$t ELECTRIC

' In making this request, General Electric is rindful not only of the practical advantages indicated above, but also of the fact that early initiation of export review by the Commission and the Executive Branch advisory agencies would be a signifi-cant step in enhancing foreign customer confidence in the timeliness and reliability of U.S.

supply, and in the work-ability of this country's export licensing process.

These are, of course, major objectives of the NNPA and of U.S. non-pro-liferation policy.

We would note, as relevant background, that neither the NNPA nor Part 110 of the Commission's regulations requires that an applicant have a firm order before seeking an export license.

In fact, a pre-order license review -- particularly for exports where there is a high probability of an award to a U.S.

supplier

-- is a practicable mechanism for accommodating the aims of supplier, customer and Government alike.

Early review advances the commercial and planning needs of the supplier and its customer and also meets the Commission's need for adequate time to determine whether the proposed export comports with the requirements of NNPA.

We thus believe that an early beginning of the export licensing process serves the interests of the con-cerned parties and the broader public interest as well.

Accordingly, General Electric respectfully that these applications be reviewed as if firm orders for Units 7 and 8 had been received.

We are, of course, prepared to cooperate fully with you and with the Executive Branch agencies conducting referral reviews.
