Our letter of February 8,1980 for Amendnent to Certificate of Compliance No. 71-5957 (2) Your letter of March 3, 1980 Enclosed is our check for $2,110 for the balance due on the fee for license review under Category llB of Section 170.31 of Part 170.
Our previous check for $690 was sent since our interpretation of Section 170.31 of Part 170 it that the specific contents for which this amendment is made come under Category llc even though the cask also can be used for contents which fall under Category llB.
We are aware, however, that only actual costs incurred are charged and that the amount of overpayment is refunded. Therefore, in order to expedite the license review, we are submitting the additional funds you requested though we do not fully agree that the amendment review comes under Category llB.
