Dear Mr. Buckley:
In response to your appeal under the Freedom of Information Act for records pertaining to three Westinghousa license applications, for staff papers on procedures and policies of export licenses for nuclear fuel and facilities, and for other records concerning the Philippine Power Reactor, the Com-mission has taken the following actica:
1.
Eight documents are to be publicly released and are appended to this letter.
2.
Two documents are to be disclosed in part and withheld in part. The disclosed portions are attached to this letter. The remaining por-tions are withheld under Exemption 5 (5 U.S.C. 552(b)(5); 10 CFR 9.5(a)(5)).
These portions, which are taken from communications between a Commissioner and a legal assistant in his office, are advisory in nature and do not contain reasonably segregable, non-exempt factual statements.
3.
One document is withheld in full. The document is a communication between Commissioners and is covered in its entirety by Exemption 5.
See Sterling Drug Inc. v. FTC, 457 F.2d 698, 708 (D.C. Cir.1971).
Also, one paragraph contains information which is properly classified under E.0.12065, and is covered by Exemption 1 (5 U.S.C. 552(b)(1);
No reasonably segregable, non-exempt portions are withheld.
Public access to these documents, other than as described above, would not be in the public interest. This action of the Commission, including the denial of documents, is a final agency action for which judicial review is available in a district court of the United States in the district in which you reside or have your principal place of business, or in the District of Columbia.
