2 FINDINGS AND DETERMINATION Under section 302(c)(10) of the Federal Propert, and Administrative Services Act c 1949, as Amended Firlings In accordance with the requirements of Section 9-3.301 of the AEC Procurement Regulations, which incorporates by reference FPR 1-3.3, I make the following findings:
The Commission is currently funding confirmatory research with Battelle 1.
Columbus Laboratories (BCL) entitled, " Development of Analytical Models of Fission Product Transport and Disposition Under Accident Conditions" in which specific analyses of fission product transport and disposition i
for reactor primary systems and spent fuel transportation casks under hypothetical loss-of-coolant accident (LOCA) conditions are investigated.
BCL has been under contract to NRC (and previously AEC) since 1972 to 2.
study such accident phenomena in Light Water Reactors (LWR's).
Since January 1976, one part of that effort (this contract) has been the development of mechanistic models of fission product transport in During that period of time, BCL has provided for NRC the LWR's.
framework of a versatile, modular, computer code (TRAP) which has the potential for calculating deposition of fission products on the internals of the reactor coolant boundary during major postulated accidents including controlled LOCA and meltdown.
At this time, the sponsoring Program Office, the Division of Reactor 3.
Safety Research of the Office of Nuclear Regulatory Research, proposes to extend this contract for one final year in order to allow the con-Of the previously clusion and wrap-up of the TRAP code development work.
authorized research program, only one small experimental task remains to be completed.
It is anticipated that this one item can be accomplished within a 10 month period at an estimated cost of $96,000.00.
'The present Contractor is the only organization in a position to under-4.
take this additional concluding experimental program of work.
Procure-ment from another source is not practical since:
A novel and unique experimental apparatus has already been a.
constructed at BCL for these experiments.
These experiments require prototypic LWR primary system material b.
samples which have been conditioned under a simulated LWR primary BCL has acquired these material samples and system environment.
has developed a method for exposing the samples to simulated LWR primary system environmental conditions.
l.,
2 The researchers at BCL have develop d the expertise to success-fully conduct these experiments and are available for continuation c.
Ft.rthermore, these researchers of this research during FY 1980.
have been closely involved in TRAP computer code model development and are intimately familiar with the data needed for development of the TRAP computer code models.
A new contractor would require approximately 6 months and additional d.
funds to construct a test facility similar to the one now available This delay would seriously hinder the development of the at BCL.
TRAP computer code and planned analysis with the code (such as TMI fission product release calculations to support containment decon-taminationefforts).
l Determination Based upon the' foregoing findings, I hereby determine within the 1.
meaning of Section 302(c)(10) of the Federal Property and Administrative Services Act of 1949, as amended, and the Atomic Energy Act of 1954, as amended, that:
i It is neither feasible nor practicable to undertake this a.
requirement.i-house; It is impracticble to secure competition by formal b.
advertising due to the far.t that it is impossible to draft specifications or r.n adequate detailed description of the required services for an invitation for bids; Negotiation on a sole source basis with Battelle Columbus c.
Laboratories in the performance of the additional confirmatory research in the subject area is justified based on the organiza-tion's unique position as the developer of the basic information which is to be expanded upon in this proposed research effort.
BCL is the only organization available which can meet the minimum needs of the Government in this requirement.
Upon the basis of these findings and determination. I hereby detennine 2.
that negotiation of a contract with Battelle Columbus Laboratories, for the procurement of the work described herein, is authorized by law,
