Dear Mr. Cochran:

This is in further response to your letter dated November 23,1977 in which you requested, pursuant to the Freedom of Information Act, a copy of all records received, considered or approved by the NRC or its Commissioners, that were used by the staff in preparing the Draft Safeguards Supplement i

prepared in connection with the GESMO proceedings.

The seven-volume contract report by Lulejian and Ass 6ciates. Inc.

entitled " Development of the Safeguards Supplement-Documentation of Support Provided by Lulejian and Associates, Inc." contains Restricted j

Data and National Security Information.

The statutory authority for withholding Restricted Data is found in Section 141 through 145 of the Atomic Energy Act (42 U.S.C. 2161-2165).

Similarly, Executive Order 12065 prohibits the unauthorized disclosure of National Security Information.

This report is being withheld from public disclosure pursuant to Exemptions (1) and (3) of the Freedom of Information Act (5 U.S.C.

552(b)(1) and (3)) and 10 CFR 9.5(a)(1) and (3) of the Commission's regulations.

The report describes the contractor's work in developing analytical methodologies appropriate for comparative parametic evaluation of alternate safeguards programs.

The report establishes concepts and expresses those concepts in terms of mathematical notations and equations which relate the variables within the concept. Values assigned to certain variables cannot be segregated from the remainder of the discussion of values considered for other variables.

If certain quantities were to be deleted from the text, the remainder of the text could be used to derive the deleted information.

Therefore, the report is being withheld in its entirety.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. Raymond J. Brady, Director, Division of Security.

This denial may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter.

As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."

This completes action on your request.
