Dear Mr. Runningen:
This is in response to your letter dated March 28, 1980, in which you
requested, pursuant to the Freedom of Information Act, a copy of NRC's
report on its investigation of alleged security breaches at Commonwealth
Edison's nuclear power plant at Cordova, Illinois.
Upon receipt of your letter, we once again contacted the Headquarters
staff of the Federal Bureau of Investigation (FBI).
They requested that
the report be withheld from public disclosure pursuant to exemptions
(7)(A) and (B) of the Freedom of Information Act (5 U.S.C. 552(b)(7)(A)
and (B)) because its release would interfere with an (aforcement proceeding
and could deprive a person of the right to a fair trial or an impartial
adjudication.
Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been
determined that the information withheld is exempt from preduction or
disclosure, and that its production or disclosure is contra: y to the
public interest. The persons responsible for this denial are the undersigned
and Mr. David G. Flanders, Chief, Freedom of Information-Privacy Acts
Branch, FBI.
This denial may be appealed to che Commission's Executive Director for
Operations within 30 days from the receipt of this letter. As provided
in 10 CFR 9.11, any such appeal r
be in writing, addressed to the
Executive Director for Operations, . 5. Nuclear Regulatory Commission,
Washington, DC 20555, and should clearly state on the envelope and in
the letter that it is an " Appeal from an Initial F0IA Decision."
