Dear Mr. Chaifetz:
This is in response to your letter dated April 7,1980 in which you requested, pursuant to the Freedom of Information Act (F0IA), copies of all documents made available to NRC and requested by members of the public under the F0IA. A search of our records indicates that the NRC has not been asked by a requester for information concerning Union Carbide Corporation.
This will also confirm the telephone conversation which you had with Mr.
John C. Carr of my staff on April 9, 1980, where he explained the policy of NRC in cooperating with corporations in protecting proprietary or commercial information.
As a matter of practice, prior to the disclosure of any properly marked proprietary material submitted to the NRC in connection with a contract or licensing function, we routinely contact the company to reconfirm its proprietary claim. A sample letter of inquiry is onclosed, If the NRC subsequently determined that the information was not to be afforded proprietary status, the company would again be notified before the release of the information.
It is felt that by following this procedure, the NRC can adequately discharge its responsibilities to the public and at the same time preserve the legitimate claims of the owner of the proprietary information. We will continue to pursue this policy in an effort to strike a proper l,alance between the public and private interest in the proper administration of the Freedom of Information Act.
