Dear Dave:

As discussed in our telephone conversation of Monday, March 10, 1980, Houston has a' greed to forego the deposition of the Department's former~ expert witness, Mr. ~

William Scott, in return for the Department's stipulation and agreement that the documents produced to Houston out of Mr. Scott's files are business records within the meaning of Rule 803(6) of the Federal Rules of Evidence.

Consequently, Mr. Scott's deposition scheduled for March is canceled. This cancellation is, of course, based upon the Department's earlier repr'esentation to the Board that Mr. Scott would not be called as an expert witness.

Should the Department decide otherwise, Houston reserver, its right to further depose Mr. Scott concerning work done and opinions reached subsequent to his last deposition.
