Reouest for Hearing and Petition for Leave to Intervene in Evidentiary Hearings on Proposed Technical Specifications In response to the Nuclear Regulatory Commission's (NRC) order and notice ( A5 Federal Register 11282, dated 20 February 1980) and in accordance with 10 CFR part 2, I, iiilliam A. Lochstet hereby recuest a hearing with respect to caragraph (2) of this notice, and petition for leave to intervene in these evidentiary hearings.
1 Nature of the Peritioner's right under the Atomic Energy Act to be made a party to the proceding.
The rights of this retitioner are set forth in and result from sections 1, 2, 3,170, and 189 of the Atomic Energy Act, as amended. It is held that the operation and recovery of TyI-2 will adversely affect my health, mental health, security, socia-1 and political status, a nd genetic condition of my progeny. Therefore, my general welfare as well as he:lth, safety and security will be affected.

I thus have occasion to breathe the air in the vicinity of the plant. I also consume food grown in the area both on those occasions of visitation to the area and also while residing in State College. There is thus uncertainty in the amounts of radioactivity contained in the foodstuffs of these areas due to the distribution of possibly contaminated foods grown in the vicinity of TMI.
This cloud upon foodstuffs exists even if the action levels for condemnation are not exceeded.
Since the linear, non-threshold relationship between radiation dose'and effect must be used for oublic health considerations, any exposure, or any censumntion of food co'ntaining radioactive products from TMI-2 must be considered a health threat.
To avoid contaminated foodstuffs would recuire more care and time spend in selecting foods and create an unreasonable burden.
Such concerns in the general public could make all of Pennsyivania undesirable as a place of residened and depress property values.
3 Fossible effect of anf order which may be entered in the proceeding on the petitioner's interest.
Any odder which establishes technical specifications for the recovery mode cf 'T?H-2 will have an effect on the quantities of radioactive materials emitted to the air, water and ssil in t he plant vicinity.
In particular, if the technical sp4cifications are inadequate, an unforseen condition may i
result.which could result in unusually large releases, The magnitudes of normal releases which will occur will also be affected by these technical specifications, regardless of whether they are within limits that a.re allowabbe, or not.
It is because ~of this control on the releases, an'd their l
3 health effect as described above that the petitioners intereste are affected.
Contention-1:
The proposed technical specifications do not provide n.decuate protection of my health, safety and property.
