The first one is SECY-A-80-20, which is 6
Consumers Power (Midland) Nuclear Plant, Unit 1 and 2.
7 The Commission has approved unanimously a Notice of Hearing directing the Licensing Board to consider 9
certain issues.
10 Commissioner Bradford, although approving along 11 with the other Commissioners, would have allowed the Board 12 to consider whether the I&E action went-far enough as to 13 corrective actions, and to seek civil penalty unless I&E 14 knows of some mitigating circumstances not apparent in this 15 paper.
16 I would ask you to affirm your votes?

SECY-80-95, the Commission has 20 unanimously denied a petition for rulemaking filed by the 21 State of New Hampshire requesting NRC and six other Federal 22 agencies to not go into proceedings t.o adopt to achieve il' 23 efficiency in: licensing, construction operation of nuclear 24 plants.

3 is a redraft of the opinion in the Atlantic Research 4
Corporation.
5 The Commission, with a 4-1 vote with Commissioner 6
Kennedy dissenting has approved the issuance of a Memorandum 7
and Order to vacate and remand ALAB 542 to the Appeal Board 8
for further consideration.
The package consists of an 9
Order, a separate concurring view of Commissioner Hendrie, 10 which was circulated within the past week, and the' dissent 11 of Commissioner Kennedy.

SECY-80-81A, the Commission, by a 19 4-1 vote with Commissioner Kennedy abstaining has approved 20 the statement of policy on licensing which is distributed 21 to all of you.
22 COMMISSIONER KENNEDY:
Let me add, the reason 23 for my abstention, I consider this on'e'of the most poorly Sy) 24 drafted pieces of paper I have seen in five years in this 25 institution.
Knowing the difficulty that-the public.has

l on a regular basis in understanding our outpourings, this 2
one should give them more pause than usual, and thus, while 3
I understand the basic reasons for and the need for some 4
sort of policy statement, I would hope it will be one that 5
will be helpful to the public, not just confusing.

Let's see, I would say 10 that there is -- Commissioner Kennedy's views are not 11 entirely without merit here.

Yes.
16 CHAIRMAN AHEARNE: Then I don't think it is 17 affirmed.
