LICENSEE'S MOTION TO EXTEND SCHEDULE FOR i

RESPONSES TO INTERVENOR INTERROGATORIES Licensee reluctantly requests that the schedule for i

Licensee's responses to interrogatories filed by intervenors on or after February 13, 1980, be extended from March 17,'1980 to March 31,'1980.

As required.by the Board's Memorandum on Revised Discovery Schedules dated February 20, 1980, Licensee will, however, file any objections it may have to such inter-rogatories within 15 days following the service thereof upon Licensee.

Since the time of the Board's rulings extending the.

time for discovery requests, i.e.

first extending the deadline for discovery requests to February 16, 1980, and then further extending the deadline for discovery requests to February 25,

- 1980, Licensee has received the following interrogatories:-

February 14 --Lewis Third Set February 15 - Newberry First' Set 4

February 16 - Aamodt First Set February 21 --Lewis Fourth Set February 22 - Aamodt Second Set-February 22 - Aamodt Third Set-February 22 - Aamodt Fourth Set February 22 TMIA Seventh Set February 25 - ANGRY Second Set February 25 - Sholly Fourth Set February 25 - Aamodt Fourth (sic) Set i

February 25 - Aamodt Third (sic) Set February 25 - UCS Second Set February 25 - CEA First Set Collectively the above interrogatory requests contain approximately 315 interrogatories, not counting subdivisions.

The interrogatories filed by the Aamodts, CEA and Newberry rep--

I resent the first discovery efforts made by these intervenors since the formal discovery period opened on December 18, 1979, at which time it was contemplated that all general discovery l

l would be completed by February 16, 1980.

Licensee doubts whether under any circumstances it would be.possible to respond by March 17 to the large volume of last-minute interrogatories filed by intervenors.

Responses must be coordinated by Licensee's counsel in Washington with GPU licensing engineers-in Pa,rsippany, New Jersey,-and input to.most of the interrogatories must be obtained from Met Ed.

personnel at the TMI' site, from Met Ed's architect-engineer in Reading, Pennsylvania, ' or from B&W in Lynchburg, Virginia.

Certainly, however,- the March 17 date could not be met with-out severe interference, as predicted'by Licensee's counsel 1

at the February 13 prehearing conference, with the prepara-tion and filing of information requested by the NRC Staff for inclusion in its Safety Evaluation Report.

Respectfully submitted, SHAW, PITTMAN, POTTS & TROWBRIDGE h*/
