MEMORANDUM AND ORDER ADMITTING KENTUCKY AS AN " INTERESTED STATE" (April 1, 1980)
By petition filed on March 4,1980, the Commonwealth of Kentucky seeks admission to this proceeding as an " interested State" pursuant to 10 CFR 52.715 (c).
It states that it has an interest in all of the findings which the Commission must make in this operating license proceeding and that it is particularly.
concerned about the adequacy of emergenef planning.
Kentucky also makes a showing of asserted good cause for its delay in seeking admission - a showing which, we have previously held, an entity participating under 10 CFR $2.715(c) is not required to make.

'h? Applicants offer no objection to admission of the Comm nwealth, although they point out that their discussions with Kentucky hopefully will obviate the need for such 8004080 f g
. participation.
They request, however, that we impose the same conditions for participation as we did for the City of Mentor, i.e.,
that it "must take the proceeding as it finds it."

The NRC Staff supports
,the admission of Kentucky, provided the Commonwealth takes the proceeding as it finds it and does not seek to litigate issues on which hearing is complete.
Subject to its taking the proceeding as it finds it, the Commonwealth of Kentucky is hereby admitted to this proceeding as an " interested State," pursuant to 10 CFR 52.715(c).
