On February 28, 1980 the Department of Justice (" Department")

filed a Motion to Compel, seeking to have the Board ordi- Houston d

Lighting & Power Company (" Houston")' to supplement its prior responses to the Department's First Set of. Interrogatories.

Houston has already voluntarily filed its supplementary answers to the Department's Interrogatories with the exception of i one Interrogatory relating to expert engineering testimony which Houston is in the process of updating. 1/ The Department's Motion was served one day after Houston's supplementary answers were filed with the Commission. Evidently, Houston's answers.and the i

Department's motion to compel crossed in the course of delivery.

Houston'having already submitted its supplementary answers, the Department's motion should be dismissed as moot.

In supplementing its answers, Houston reviewed all of its previous responses to see which ones required updating. However, the Department's motion seeks updated responses to some interroga-tories which Houston, in preparing its updated answers, did not believe required supplementation. The Department stated no grounds in its Motion for seeking supplementation of particular interrogatories, md Houston at this time has no grounds to be-lieve that further supplementation is necessary. However, Houston will once more review the additional interrogatories enumerated in the Department's motion to determine whether any prior response thereto requries supplementation. (Houston will be receptive to informal discussion with the Department on this point.) To the extent any further supplementary responses ap-pear appropriate, they will be filed as soon as possible.
