Dear Senator Proxmire:

This is in response to your memo of January 28, 1980, which forwarded an inquiry from George Nygaard and Anne Morse concerning the La Crosse Boiling

. ater Reactor, LACBWR.

Since the Nuclear Regulatory Commission is not W

involved in the promotion of the nuclear industry, we suggest that the questions relative to Federal funding of the LACBWR be referred to the Department of Energy (DOE). The construction and initial operation of LACBWR was funded by the Atomic Energy Commission (AEC), as part of the Nuclear Power Demonstration Program.

The operations office, which was the AEC contracting office for LACBWR, is now in DOE.

The Coulee Region Energy Coalition was admitted in 1978 as an intervenor party to participate in two proceedings before the Commission's Atomic Safety and Licensing Board.

The first proceeding has recently concluded with issuance of the Licensing Board's decision approving a license amendment for LACBWR. One issue has been referred by the Licensing Board for review by the Commission's Atomic Safety and Licensing Appeal Board.

This issue concerns requirements of the National Environmental Policy I

Act as it applies to the amendment proceeding.

Presently, a second proceeding has begun to consider the 1974 application i

by Dairyland Power Cooperative for conversion of its provisional operating license to a full-term license.

The Commission issued, in 1976, a draft environmental statement of all environmental factors to be considered in the proposed license conversion. The draft statement was circulated to appropriate Federal and State agencies for comment and also made avail-able to the public.

The final environmental statement is near completion.

1 A hearing will be held by the Atomic Safety and Licensing Board in the near future to consider evidence addressing several environmental conten-tions submitted by the Coalition for hearing.

At the conclusion of i

hearing, the Licensing Board will decide if the environmental impacts of granting a full-term license for the LACBWR would preclude issuance of the license by the Commission.
