Dear Mr. Scott:
Your letter to Chainnan Ahearne dated February 20, 1980 has been referred to me for answer.
You asked in your letter that a public hearing be held under section 2.206 of the Commission's regulations prior to the issuance of a fuel load license to the Tennessee Valley Authority for the Sequoyah Nuclear Plant, Unit One.
Petitions to intervene are governed by section 2.714 of Title 10 of the Code of Federal Regulations (10 CFR 52.714) rather than 10 CFR 52.206. A notice of opportunity for hearing on the application by the Tennessee Valley Authority for an operating license for the Sequoyah Nuclear Plant was published in the Federal Register on March 25,1974(39F.R.11131). A copy of that notice is enclosed.
Under the terms of the notice, petitions for leave to intervene were to be filed by April 25, 1974. The notice also stated that a petition for leave to intervene which was not timely filed would not be granted unless it was determined that the petitioner had made a substantial showing of good cause for failure to file on time and after consideration of the factors specified in 10 CFR 62.714(a)(1)-(4) and (d) of the Commission's Rules of Practice.
The Commission approved the issuance of a low power test license to Tennessee Valley Authority for the Sequoyah Nuclear Plant, Unit One, on February 29, 1980.
A copy of the license and the notice which will be published in the Federal Register is enclosed for your information.
