APPLICATION FOR ISSUANCE OF SUBPOENA Ilouston Lighting & Power Company, pursuant to 10 C.F.R.

SS2.740 and 2.741, applies for the issuance of the attached Subpoena, which calls for a deposition requiring the attend-ance of the party listed, and for production of documents.

The testimony and document production sought encompasses, but is not limited to, the testimony to be given in the instant proceeding, and all work performed for Central and Southwest Corporation or any of its subsidiaries, concerning interest in and awareness of nuclear power projects, interconnections and operations involving interstate systems and the Texas Interconnected Systems, bulk electric power supply, transmis-sion' planning, fuel supply for electrical generation of elec-tricity, and/or any issue in this proceeding.

On motion made promptly, and in any event at or before the time specified in the subpoena for compliance by the person to whom the subpoena is directed, and on notice to the party at whose instance the subpoena was issued, the presiding officer or, if he is unavailable, the Commission may (1) quash or modify the subpoena if it is unreasonable or requires evidence not relevant to any matter in issue, or (2) condition denial of the motion on just and reasonable terms.

Arcy, or any person working with him, in connection with any work performed for Central and South West Cornoration, or any of its subsidiaries, since October 31, 1978.

All documents which set forth, contain information about, refer or relate to instances of competition in any phase of the electric utility industry involving:

(1) Houston Lighting &

Power Company and/or (2) Texas Power and Light Company and/or (3) Texas Electric Service Company and/or (4) Dallas Power and Light company; or to any communications with any of the afore-mentioned entities.

All documents provided to or received from the U.S. Depart-ment of Justice or the U.S. Nuclear Regulatory Commission or any of their consultants or designated witnesses in connection with this proceeding, or the licensing of any nuclear powered electric generation plant.
