Dear Mr. Eizenstat:
The Nuclear Regulatory Commission has recently received a request from Rochester Gas and Electric Corporation for permission to utilize four mixed oxide fuel assemblies, containing approximately 47 kilograms of plutonium, in their Ginna reactor. The. utility states that the purpose of using the assemblies is to provide information as a part of a research, demonstration and development program.
Such use may be consistent'with the NRC December, 1977 decision terminating the GESMO proceeding and with your letter to Chairman Hendrie of October 1977, which retained the possibility of licensing the use of small quantities of mixed oxide fuel or experimental purposes. The Commission is considering issuing a license amendment to Rochester Gas and Electric to permit use of these mixed oxide fuel assemblies for the stated purpose following the refueling outage scheduled for April, 1980.
The Commission would appreciate the Executive Branch view of whether approval of this proposed activity would adversely affect U.S. non-proliferation policy. Your timely attention to this matter would be greatly appreciated.
