Inspection No. 70-1100/79-12 This refers to the inspection conducted by Mr. Nemen Terc of this office on December 12-14, 1979, at Combustion Engineering, Incorporated, Windsor, Connecticut of activities authorized by NRC License No. SNM-1067 and to the discussions of our findings held by Mr. N. Terc with Messrs. J. Pianki and other members of your staff at the conclusion of the inspection, and to a subsequent telephone discussion between Mr. N. Terc and Mr. P. Rosenthal on January 4, 1980 and between Mr. Tere and Mr. G. Bakevich on December 20, 1979.

Areas examined during this inspection are described in the Office of Inspection and Enforcement Inspection Report which is enclosed with this letter.

Within these areas, the inspection consisted of selective examinations of procedures and representative records, interviews with personnel, and observations by the inspector.

Our inspector also verified the steps you have taken to correct the item of non-compliance brought to your attention in a letter dated October 4,1979. This item was referenced as 77-07-02:

" Failure to develop procedures for determin-ing the magnitude of release of radioactive materials, including guidelines for evaluating the need for notification and participation of state agencies." We have no further questions regarding your action at this time.

Within the scope of this inspection, no items of noncompliance were observed, however, as discussed during the exit interview, it is our understanding that a second generation of emergency procedures will be composed and submitted to us within 90 days of receipt of this letter.

If this understanding is not correct, please advise us within 20 days by letter as to your position in this matter.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter and the enclosed inspection report will be placed in the NRC's Public Document Room.

If this report contains any information that you (or your contractor) believe to be pro;;cietary, it -is necessary that you make a written application within 20 days l
